Title 21 › Chapter 9— FEDERAL FOOD, DRUG, AND COSMETIC ACT › Subchapter X— MISCELLANEOUS › § 398
When the Secretary finds believable evidence that an imported food shipment could cause serious illness or death to people or animals, the Secretary must tell the States where the food is or will be kept and the States where the food’s maker, packer, or seller is located, as far as the Secretary knows. The Secretary will ask those States to take whatever steps they think are needed to protect public health. Telling the States this way does not take away any other food-related powers the Secretary has under this law.
