§61 Definitions

Summary

Defines three words used in the chapter. "Person" covers an individual, partnership, corporation, or association. "Interstate or foreign commerce" means trade that crosses State, Territory, possession, or District of Columbia lines; trade inside a State/Territory/possession/D.C. that passes through a place outside them; or trade within any Territory, possession, or the District of Columbia. "Filled milk" means milk, cream, or skimmed milk in any form (condensed, evaporated, concentrated, powdered, dried, or desiccated) that has had non‑milk fat or oil added to make it imitate milk. A special proprietary infant food is not "filled milk" if it (1) is made for infants on a physician’s order, (2) comes in cans of not more than sixteen and one‑half ounces with a bold label saying it is only for that use, and (3) is shipped in interstate or foreign commerce only to physicians, wholesale and retail druggists, orphan asylums, child‑welfare associations, hospitals, and similar institutions and generally sold by them.
