Title 22 › Chapter 111— AUSTRALIA, UNITED KINGDOM, AND UNITED STATES (AUKUS) SECURITY PARTNERSHIP › Subchapter II— STREAMLINING AND PROTECTING TRANSFERS OF UNITED STATES MILITARY TECHNOLOGY FROM COMPROMISE › § 10421
The President must make rules so requests from Australia and the United Kingdom for AUKUS-related defense items and services are handled faster than other requests, except those from Taiwan and Ukraine. The Secretary of State, with the Secretary of Defense, must create a policy to allow earlier Foreign Military Sales and Direct Commercial Sales to Australia, the United Kingdom, and Canada for certain technologies not exempt under the International Traffic in Arms Regulations. Covered items include submarine and related combat systems and advanced tech like hypersonic missiles, cyber, artificial intelligence, quantum, undersea, and similar capabilities. Reviews under the policy must be expedited, and the two Secretaries must update interagency FMS/DCS guidance to include it.
