Title 22 › Chapter 21— SETTLEMENT OF INTERNATIONAL CLAIMS › Subchapter III— CLAIMS AGAINST BULGARIA, HUNGARY, RUMANIA, ITALY, AND THE SOVIET UNION › § 1641
Defines important words used in the subchapter. Person means an individual, a partnership, an association, another unincorporated group, a corporation, or a government entity. National of the United States means (A) a natural person who is a U.S. citizen or who owes permanent allegiance to the United States, and (B) a corporation or legal entity set up under U.S., State, Territory, or District of Columbia law if natural persons who are U.S. nationals own, directly or indirectly, more than 50 per centum of its outstanding capital stock or other beneficial interest; it does not include aliens. Treaty of peace means the treaty with that country signed at Paris, France, February 10, 1947, which became effective with the United States on September 15, 1947. Memorandum of Understanding means the MOU between the United States and Italy about Italian assets in the United States and certain claims of U.S. nationals, signed at Washington, D.C., August 14, 1947 (61 Stat. 3962). Soviet Government means the Union of Soviet Socialist Republics, including any of its then or former republics, political subdivisions, and territories as they existed on or prior to November 16, 1933. Litvinov Assignment means (A) the November 16, 1933 communication from Maxim Litvinov to President Franklin D. Roosevelt assigning amounts admitted or found to be due to the Soviet Government as successor to prior Russian governments in preparation for settling claims, (B) President Roosevelt’s November 16, 1933 reply accepting that assignment, and (C) assignments executed by Serge Ughet on August 25, 1933, and November 15, 1933, assigning certain assets to the United States. Russian national includes any corporation or business organized under the laws of the former Empire of Russia or any successor government that was later nationalized, dissolved, had its assets taken over by the Soviet Government, or was merged by the Soviet Government. Commission means the Foreign Claims Settlement Commission of the United States (established under Reorganization Plan Numbered 1 of 1954 (68 Stat. 1279)). Property means any property, right, or interest.
