If an agreement under section 277d–13 is made to build a major international storage dam, the Secretary of State, through the U.S. Commissioner of the International Boundary and Water Commission (United States and Mexico), may make an agreement with the proper Mexican officials under Article 7 of the treaty of February 3, 1944. That agreement can cover building, running, and keeping up, on a self-paying basis, the United States’ share of the hydroelectric power facilities at the dam. If the countries agree to build separate power facilities, the U.S. Commissioner must build, run, and maintain those self-paying facilities for the United States.
