Title 22 › CHAPTER 7 — INTERNATIONAL BUREAUS, CONGRESSES, ETC. › SUBCHAPTER IV — INTERNATIONAL BOUNDARY AND WATER COMMISSION › § 277d–26
The Secretary of State, through the U.S. Commissioner of the International Boundary and Water Commission, can make agreements with Mexican officials to carry out emergency flood control work on the lower Colorado River between Imperial Dam and the Gulf of California in both countries. These deals can cover clearing trees and brush from the river, removing silt and sediment, and taking steps to prevent new sediment build-up caused by desilting at diversion dams. If an agreement would include building or running works on the Colorado River in the United States that fall under the Secretary of the Interior’s control, it must get the Secretary of the Interior’s approval first. These actions are meant to control floods under article 13 of the 1944 Water Treaty with Mexico and follow the Memorandum of Understanding dated February 14, 1945.
