Starting in fiscal year 2023 and each year after, the EPA Administrator may move money made available under the "Environmental Protection Agency—State and Tribal Assistance Grants" heading in the USMCA Supplemental Appropriations Act, 2019 (title IX of Public Law 116–113) to the International Boundary and Water Commission, United States and Mexico. Administrator means the EPA Administrator. Commission means the International Boundary and Water Commission, United States and Mexico. The money can be sent by an interagency agreement or by a grant to pay for building treatment works that the Commission will own or run. The Commission must follow the rules in sections 1372 and 1388 of title 33 and may use the funds for planning, study, design, construction, and related admin or construction management costs. The new treatment works must protect people in the U.S.–Mexico border area from pollution caused by wastewater, stormwater, or other cross‑border flows from Mexico and from failures of Mexico’s treatment systems, and must meet local, State, and Federal law. The Commission may also use the funds to operate and maintain new facilities. The Commission can make agreements with U.S. and Mexican state officials that spell out how the two governments share operation and maintenance costs, with Mexico’s approval. This does not change the Commission’s authority under the 1944 water treaty or any other treaty. Transfers must follow regular Appropriations Committee notification rules. Amounts repurposed that were earlier labeled emergency remain designated emergency under section 4001(a)(1) of S. Con. Res. 14 (117th Congress) and section 1(e) of H. Res. 1151 (117th Congress), engrossed June 8, 2022.
