The Secretary of Defense may lend materials, supplies, or equipment to NATO or major non‑NATO allies for research, development, testing, or evaluation, and may accept loans or gifts from those allies. Each loan or gift must be in a written deal. Tests done only for standardization, interchangeability, or technical evaluation are allowed if the ally gives the results to the United States for free. The Secretary can let items be used up in testing if it is needed and approved. Strategic and critical materials cannot be lent when the National Defense Stockpile (under section 98b(a) of title 50) has less than the amount the President requires. NATO ally: a member country of the North Atlantic Treaty Organization other than the United States.
