Title 22 › Chapter 39— ARMS EXPORT CONTROL › Subchapter VII— CONTROL OF MISSILES AND MISSILE EQUIPMENT OR TECHNOLOGY › § 2797a
The President must deny U.S. government contracts and export approvals to any United States person the President finds knowingly exported, tried to export, or helped export an item listed on the MTCR Annex in violation of U.S. export laws or rules. If the item is in MTCR Category II, the denial lasts 2 years and covers U.S. government contracts related to missile gear or technology and licenses for those transfers. If the item is in MTCR Category I, the denial lasts not less than 2 years and covers all U.S. government contracts and all export licenses and agreements for items on the United States Munitions List. The President may also seek any penalties allowed under section 2778(c). If the final destination is a country the Secretary of State has found repeatedly supported international terrorism, the item is presumed to be for a missile on the MTCR Annex (this presumption can be challenged). The President may waive these sanctions for a product or service only if he certifies to Congress that it is essential to U.S. national security, that the supplier is the sole source, no reliable alternative exists, and the need cannot be met in time by better manufacturing or technology.
