§290n–3 Membership

Summary

Creates a U.S. section of the Commission with 13 members. Those are the Secretary of Health and Human Services (or the Secretary’s delegate); the health commissioners or chief health officers (or their delegates) from Texas, New Mexico, Arizona, and California; and two people who live in the United States‑Mexico Border Area in each of those four states. The eight border residents are picked by each state’s governor and appointed by the President from people tied to community groups with interest and experience in border health. The HHS Secretary (or the Secretary’s delegate) is the section’s Commissioner and leader. Members who are not federal or state employees may be paid up to the daily equivalent of the annual basic pay for GS‑15 positions under section 5332 of title 5 for each day they work for the Commission, and they may receive travel expenses and per diem at the rates under subchapter I of chapter 57 of title 5 while away from home or work for Commission business.
