A person who is at least 50 years old and has 20 years of creditable service — including at least 5 years of service credit under the System (military and naval service do not count) — may apply to retire and get retirement benefits if the Secretary agrees. The Secretary must refuse to agree for anyone who has not been a member of the Service for at least 5 years. If someone leaves before finishing 5 years in the System but, on their separation date, would qualify for a civil service annuity under sections 8336 or 8338 of title 5 if they had been covered by the Civil Service Retirement System, they can receive that annuity only if all contributions and interest that were moved into the Fund while they were under this subchapter, plus contributions taken from their pay or paid by the employer, are transferred to the Civil Service Retirement and Disability Fund effective on their separation date.
