The Endowment must follow all parts of section 552 of title 5, even though it is not a U.S. Government agency. To meet the requirements of section 552(a)(1), the Endowment must give the Director of the United States Information Agency any records or information the Director needs, and the Director will arrange for those records to be published in the Federal Register. If the Endowment decides not to give records in response to a request, it must send the Director a report saying why. If the Director approves that decision, the United States Information Agency will take full responsibility, including paying for any legal defense. If the Director does not approve, the Endowment must provide the records.
