The President may use any steps needed to get people released if they are held by, for, or at the request of the International Criminal Court. This covers covered U.S. persons, covered allied persons, and people held for official acts done while they were such persons (for allied persons, their government must ask). If one of these people is arrested or held by the ICC, the President can order U.S. agencies to provide lawyers and legal help (including under section 1037 of title 10), give exculpatory evidence, and protect U.S. interests by appearing before the ICC under Article 18 or 19 of the Rome Statute or in courts of other countries. Paying bribes or other inducements to obtain release is forbidden.
