Title 23 › Chapter 1— FEDERAL-AID HIGHWAYS › § 132
When a Federal agency will do a Federal-aid project under an agreement with a State, the State can either tell the Secretary to send the Federal share straight to that agency or pay/deposit the money the agency needs. After the agreement is signed, the Secretary may repay the State for the estimated Federal share from any available funds. If the repayment is more than the State’s approved final share, the extra must be taken back and returned to the same fund.
