After September 30, 1985, money given to the Bureau of Indian Affairs (but not trust funds) must not be used, directly or by contract, to pay general welfare benefits. Child welfare payments are allowed. The Bureau cannot pay for nonessential needs when the person could reasonably pay for them with their own money or income (including trust funds) that are not legally excluded from counting for federal aid, as defined by the Secretary or by State welfare rules under the Social Security Act (42 U.S.C. 301 et seq.). The Bureau also must not pay people who can get state public welfare, unless the Secretary of the Interior decides payments are required under sections 6(b)(2), 6(i), and 9(b) of the Maine Indian Claims Settlement Act of 1980 (94 Stat. 1793, 1794, 1796; 25 U.S.C. 1725(b)(2), 1725(i), 1728(b)).
