Title 25 › Chapter 16— DISTRIBUTION OF JUDGMENT FUNDS › § 1402
The Secretary of the Interior must, within one year after money is set aside to pay a judgment to an Indian tribe, send Congress a plan that identifies who will benefit now, proposes how the money will be used and shared, and gives a formula if the funds must be split. The Secretary must also send a copy of the plan to each affected tribe or group. Funds set aside before January 12, 1983 follow the same schedule, counted from that date. If a plan cannot be made, the Secretary must send proposed legislation and a report to Congress within the one-year period. If a split is needed, the Secretary must get the tribal governments’ consent; if consent is not obtained within 180 days, the Secretary must send proposed legislation. Either the Secretary or an affected tribe may request up to a 180-day extension, but both the Senate Committee on Indian Affairs and the House Committee on Natural Resources must approve it.
