The Secretary of the Interior can take tribal or individual Indian trust money out of the U.S. Treasury and put it in banks he picks, following rules he makes. Individual funds can only go into a bank that agrees to pay a reasonable interest rate, unless the Secretary waives interest for deposits that can be withdrawn on demand. Banks must give a bond or pledge U.S. government debt or U.S.-guaranteed obligations as security, unless the bank’s deposits are already insured under section 12B of the Federal Reserve Act. Unrestricted Indian money kept in the same bank keeps its separate insurance protection. The Secretary may also invest trust funds in U.S. public-debt or U.S.-guaranteed obligations. The rule about deposits applies to the Osage Tribe only for bank deposits. Money collected for operating Indian irrigation or power projects can be invested in U.S. public-debt, U.S.-guaranteed obligations, or other investments that are legal for U.S. trust funds. At a tribe’s or individual’s request, the Secretary may invest trust money (over $50,000) in U.S. debt or in a mutual fund if the mutual fund only holds U.S. debt or U.S.-guaranteed obligations, is registered with the SEC, and the Secretary is satisfied the fund protects the principal. The tribe or individual may have to agree to relieve the United States of liability for interest while the money is invested. Such investments count like cash or a bank deposit for section 955. The Secretary must also keep good trust management: proper accounting and reports, controls on receipts and payments, regular reconciliations, correct cash balances, timely account statements (available daily), written policies, trained staff, and proper management of natural resources on reservations and trust lands.
