The Secretary must study whether the Navajo Nation can be treated like a State for Medicaid (title XIX of the Social Security Act) so a Navajo-run agency could give services to Indians who live on Navajo lands and have the same powers as a State Medicaid agency. The study must look at putting all Medicaid payments for those Navajo residents that now go to Arizona, New Mexico, or Utah under the Navajo agency; helping the Navajo Nation build and run that agency for eligibility, payment, and services; making sure the Federal Government provides the proper matching funds for medical services and administration; and, if the Navajo Nation chooses, allowing it to be treated like a State for the State children’s health insurance program under similar terms. Not later than 3 years after March 23, 2010, the Secretary must send a report to the Committee on Indian Affairs and the Committee on Finance of the Senate and to the Committee on Natural Resources and the Committee on Energy and Commerce of the House. The report must include the study results, a summary of consultations with the Navajo Nation, other tribes, the States of Arizona, New Mexico, and Utah, affected counties and other interested parties, projected costs or savings and effects on services, and any legislation that would be needed to set up the Navajo agency.
