The Secretary may let an urban Indian organization that has a contract or grant use federal buildings, the equipment inside them, and other federal property for its work, as long as the Secretary and the organization agree on rules for use and upkeep. The Secretary can also give excess federal real or personal property to the organization for the contract or grant, and may buy excess or surplus property to donate if it is suitable. If an urban Indian organization or an Indian tribe asks for a specific item, the tribe gets priority for that donation if it asks before either the government transfers ownership or hands the item over, whichever happens first. For purposes of section 501(a) of title 40, an urban Indian organization carrying out the contract or grant may be treated as an Executive agency.
