Within one year after March 23, 2010, the Secretary must send Congress a plan, following the Service’s tribal consultation policy, that explains how and when to set up a Nevada area office separate from the Phoenix Area Office. "Operations funds" means money used to run services (overtime, salaries, benefits) and directly related tasks. If the Secretary misses the deadline, the Secretary must withhold those operations funds reserved for the Office of the Director, but not in a way that harms health care delivery. Withheld funds may be returned at the Secretary’s discretion once the Office complies.
