Allows the Secretary, through the Service, to provide or arrange long-term care for Indians in facilities, either directly or by contracting or compacting with Indian tribes or tribal organizations under the Indian Self-Determination and Education Assistance Act (25 U.S.C. 450 et seq.). Agreements must let the Service or a tribal health program share staff and other services with tribal-owned long-term care facilities. At a tribe’s request, the agreement can give the tribe needed supervision over Service employees. Shared expenses, including salaries, must be split proportionally. Agreements may allow tribes to build, renovate, or expand facilities, including ones attached to a Service facility. Nursing facilities must meet the rules in 42 U.S.C. 1396r. The Secretary must provide technical help and should encourage use of underused facilities or swing beds for long-term care.
