Title 25 › Chapter 21— INDIAN CHILD WELFARE › Subchapter I— CHILD CUSTODY PROCEEDINGS › § 1916
Even if state law says otherwise, when an adoption of an Indian child is undone or the adoptive parents end their parental rights, a biological parent or prior Indian custodian may ask the court to have the child returned. The court must grant the request unless, after a hearing under section 1912, it finds returning the child would not be in the child’s best interests. Foster, preadoptive, or adoptive placements must follow this chapter unless the child is returned to the original parent or Indian custodian.
