When a member of a tribe at peace with the United States takes or damages someone’s property inside Indian country, or crosses into a State or Territory and takes or destroys a citizen’s property (including horses), the injured person or their representative can ask the proper Indian agent to seek payment or other remedy from that tribe. If the tribe does not provide satisfaction within a reasonable time, not exceeding twelve months, the agent must report what was done to the Commissioner of Indian Affairs so the President can decide what further steps to take.
