Title 25 › Chapter 30— INDIAN LAW ENFORCEMENT REFORM › § 2813
The Director of the Office of Justice Services or the Director of the Indian Health Service must approve or deny in writing any tribal or state court request or subpoena that asks a supervised law enforcement officer, a sexual assault nurse examiner, or other employee to give documents or testify in a deposition, trial, or similar criminal proceeding about information they got while doing their job. The court must give the employee (or the agency for document requests) at least 30 days’ notice before the testimony date. The Director must approve the request if it does not violate the Department’s rule to remain impartial. If the Director does not act within 30 days after getting the notice, the request is treated as approved.
