Last updated Apr 5, 2026|Official source

Summary

For any deal that needs the Secretary’s okay and involves mineral or energy resources held in trust for a tribe, the value study (appraisal) can be done by the Secretary, by the tribe, or by a certified outside appraiser hired by the tribe. The Secretary must look at any appraisal sent by a tribe or its appraiser within 45 days. The Secretary must approve it unless it does not meet the standards in the rules the Secretary creates. If the Secretary rejects an appraisal, the Secretary must send a written note to the tribe listing each reason and how to fix it. The Secretary must make rules that say what the standards are.
