Title 25 › Chapter 10— DESCENT AND DISTRIBUTION; HEIRS OF ALLOTTEE › § 372–2
Starting in fiscal year 2006 and each fiscal year thereafter, for deciding Indian probate cases at the Department of the Interior, a hearing held by an Indian probate judge counts as meeting the hearing rules in chapter 10, even if other laws say otherwise. The Secretary appoints these judges without using the usual competitive service rules in title 5 and decides how long they serve. The Secretary may set their basic pay without following chapter 51 and subchapter III of chapter 53 of title 5, but pay cannot exceed the maximum rate for the highest General Schedule grade, including locality pay.
