Title 25 › Chapter 10— DESCENT AND DISTRIBUTION; HEIRS OF ALLOTTEE › § 375
An Oklahoma probate court can decide who the heirs are for a deceased citizen allottee of the Five Civilized Tribes if the heirs are restricted. That decision is final, though it can be appealed the same way as other probate appeals. If the time to start estate administration has passed or there is no proper ground to start it, a verified petition may be filed just to determine heirs and the court will act as if administration had begun. This cannot reopen an heirship already legally decided. Unknown heirs can be served by publication, and if they do not appear and ask to be heard within six months after the final order, they are bound like those personally served.
