Unallotted lands for oil or gas must be offered for sale to the highest qualified bidder at a public auction or by sealed bids, on terms set by the Secretary of the Interior and after public notice. The Secretary can reject all bids, readvertise, or—if the tribal council agrees—make a private lease when bids are unsatisfactory or would harm Indian interests. Tribes under sections 16 and 17 of the Act of June 18, 1934 (48 Stat. 984) [25 U.S.C. 5123, 5124] keep their leasing rights under that Act and 25 U.S.C. 5101 et seq.
