§400a Lease for Mining Purposes of Land Reserved for Agency or School; Disposition of Proceeds; Royalty

Summary

The Secretary of the Interior can lease reservation land set aside for agency or school use for mining. Leases must be sold at public auction after at least 30 days’ public notice, under rules the Secretary sets and the same laws that apply to other reservation land. Money from the leases goes into the U.S. Treasury credited to the Indians for whom the land is held and may be used by Congress for Indian education or for agency administration costs. Each lease must reserve a royalty of at least one‑eighth.
