Title 25 › Chapter 12— LEASE, SALE, OR SURRENDER OF ALLOTTED OR UNALLOTTED LANDS › § 400a
The Secretary of the Interior can lease, by public auction with at least 30 days’ notice, reservation land set aside for agency or school use for mining. He must follow the same laws that apply to other reservation lands. Money from the leases goes into the U.S. Treasury for the Indians named and may be used only if Congress approves it for Indian education or agency operating costs. Every lease must reserve a royalty of at least one-eighth.
