Title 25 › Chapter 12— LEASE, SALE, OR SURRENDER OF ALLOTTED OR UNALLOTTED LANDS › § 409
An Indian who has been given land that normally cannot be sold, and whose land is inside a reclamation project approved by the Secretary of the Interior, may sell part of that land under rules the Secretary makes and with the Secretary’s approval; an approved sale gives the buyer full, unrestricted title. The sale money must be placed in the Treasury of the United States and used by the Commissioner of Indian Affairs to pay construction charges assessed against the unsold part and maintenance during the trust period, and any surplus is a benefit tied to the water right and paid to its holder.
