Each year, if money is available, the Secretary must give grants on behalf of Indian tribes to pay for affordable housing activities under Part A and for tribe-run housing programs under Part B. The grant money is paid to the tribe’s chosen recipient. A tribe can get a grant only if it sends an Indian housing plan for that year and the plan is approved under sections 4112 and 4113. The Secretary can waive those plan rules for up to 90 days if the tribe cannot meet them because of an emergency beyond its control. The size of a grant equals the allocation listed under section 4151 for each tribe; if a recipient helps more than one tribe, the grant is the sum of each tribe’s allocation. Grant money must be used for approved affordable housing work that matches the tribe’s plan, except that the Secretary will allow a set percentage to be used for planning and reasonable admin costs, including salaries and making the housing plan. Grants cannot pay for rental or lease-purchase homes owned by the recipient for the tribe in a local area unless the local government agrees to cooperate, or the Secretary waives that rule if the recipient tried in good faith and will make payments in lieu of taxes until the problem is fixed. For units built under the U.S. Housing Act of 1937 or with these funds and owned by the recipient, the units must be tax-exempt and the recipient must make yearly user fees or payments in lieu of taxes equal to the greater of $150 per unit or 10 percent of the difference between the shelter rent and the utility cost, unless a law or local agreement says otherwise. If those rules are not met, a grant can still be made only if the local government pays or forgives taxes so the tax amount does not exceed the required amount. Recipients must try to involve private companies and nonprofits. If a tribe chooses, it and its housing entity may be treated like an Executive agency under section 501 of title 40 for buying supplies. Tribal hiring and contracting preference laws apply when a grant is meant to benefit a single tribe.
