The Secretary must publish a notice in the Federal Register within 90 days after October 26, 1996 that sets the rules needed to move housing assistance from the old law to the rules of this chapter. That notice must ask for public comments and include a general notice of proposed rulemaking. Final rules to carry out the chapter must be issued by September 1, 1997 and must take effect no later than the chapter’s effective date. All rules under this chapter must be made through a negotiated rulemaking process. After any reauthorization (including the 2008 reauthorization), the Secretary must set up a negotiated rulemaking committee within 180 days, using procedures that respect the government‑to‑government relationship with tribes and include only federal and geographically diverse tribal representatives; tribes may choose to be represented by tribally designated housing entities. The Secretary must begin negotiated rulemaking within 90 days of reauthorization, finish regulations within 2 years, and review the rules with tribes at least once every 7 years. The chapter took effect on October 26, 1996.
