After September 30, 1997, HUD money under the United States Housing Act of 1937 cannot be used for Indian housing that was built or run under a contract between the Secretary and an Indian housing authority, unless the funds come from fiscal year 1997 and the commitment was made before September 30, 1997. If a tenant-based assistance contract for such housing is ended, that housing will be treated as a dwelling unit under section 4152(b)(1) starting the next fiscal year and each year after. Also after that date, housing developed or run under those contracts is no longer covered by the 1937 Act or by annual contribution contracts under it, and must instead be kept and treated as affordable housing under this chapter.
