Title 25 › Chapter 43— NATIVE AMERICAN HOUSING ASSISTANCE AND SELF-DETERMINATION › Subchapter VIII— HOUSING ASSISTANCE FOR NATIVE HAWAIIANS › § 4223
The Secretary must require the Director to send in a housing plan every fiscal year and must review each plan. Each plan must follow the form the Secretary sets. For the 5-year period starting with that fiscal year, the plan must say the Department of Hawaiian Home Lands’ mission to help low-income families, list goals and objectives, and give an overview of planned activities showing how they will meet the mission and goals. For the specific fiscal year covered, the plan must list yearly goals and explain the housing needs of the low-income families served and how those needs will be met, including estimated needs, geographic distribution, and needs for all families. The plan must include an operating budget that names available financial resources and how they will be used (including affordable housing activities and administrative costs). It must describe current and planned housing resources and the Hawaii housing market, explain why grant money will go to rental help, building new units, buying, or rehab, and show coordination with other government and private programs and federal housing tools. The plan must describe homeownership, rental, rehab, and other help (like transitional, homeless, college, and supportive housing), any planned demolition or disposal and its timetable, how welfare agencies will help residents get jobs, safety and crime-prevention rules and resident input, who will run the projects and their capacity, and provide certifications showing compliance with Title VI or the Fair Housing Act and other federal laws, insurance rules, and policies on eligibility, rents, and maintenance. The law allows the program to serve Native Hawaiians and to limit eligibility to Native Hawaiians, and, when possible, the Department must use experienced private nonprofit groups to carry out affordable housing activities.
