Title 25 › Chapter 45— PROTECTION OF INDIANS AND CONSERVATION OF RESOURCES › § 5108
The Secretary of the Interior may buy or accept land, water rights, or surface rights for Indians by purchase, gift, exchange, assignment, or relinquishment. These acquisitions can be inside or outside reservations and can include trust or restricted allotments, whether the allottee is living or dead. Up to $2,000,000 may be appropriated from the Treasury each fiscal year to pay for the land and related costs, but none of that money may be used to buy additional land outside the Navajo Reservation boundaries for Navajo people in Arizona, or to buy such land in New Mexico if a law defining the Navajo Reservation boundaries in New Mexico becomes law. Unspent funds remain available until used. Any land or rights obtained under this law or the Act of July 28, 1955 (69 Stat. 392) must be held in the United States’ name in trust for the tribe or individual and are exempt from State and local taxes.
