Title 25 › Chapter 46— INDIAN SELF-DETERMINATION AND EDUCATION ASSISTANCE › Subchapter II— CONTRACTS WITH STATES › § 5346
When a school district uses federal contracts to educate Indian children and the local school board is not mostly Indian, the parents of those Indian students must elect a local committee from among themselves. That committee must help plan the programs under the contract and can approve or reject them. The Secretary of the Interior will set the committee’s duties and structure. If a local Indian committee or advisory board already existed before January 4, 1975, the tribal governing body can choose to use it instead. If a contractor stops the local committee from doing its duties, the Secretary of the Interior may cancel the contract.
