Unless another law says otherwise (including section 101(a) of the PROGRESS for Indian Tribes Act), the Secretary must read and apply federal laws and rules in ways that make it easier to put programs into funding agreements and to run those agreements. An Indian Tribe can send a written request asking the Secretary to waive a specific part of a federal rule. The request must point to the exact text and explain why. The Secretary must approve or deny it in writing within 120 days, unless the tribe and Secretary agree to more time. The Secretary will name one or more Department officials to get a copy of the request. The Secretary can deny a waiver if federal law forbids it. If the Secretary does not decide in time (including any agreed extension), the waiver is treated as approved, except that requests about programs under sections 5363(b)(2) or 5363(c) are treated as denied. The Secretary’s decision is final inside the Department.
