A participating Indian Tribe can choose to include any parts of subchapter I in a compact or funding agreement under this subchapter, except as limited by section 201(d) of the PROGRESS for Indian Tribes Act. The inclusion must not conflict with section 101(a) of that Act. Any part the tribe adds has the same legal effect as if it were written here. Those parts can add to or replace related rules and apply to any agency covered by this subchapter. If the tribe asks to add them during negotiations, the additions take effect immediately and govern the talks and the final compact or agreement.
