The Secretary must begin a negotiated rulemaking process within 90 days after October 21, 2020 to write rules needed to carry out this subchapter. Proposed rules must be published in the Federal Register by 38 months after October 21, 2020, and the authority to make those rules ends 50 months after October 21, 2020. The rulemaking committee may include only Federal and Tribal government representatives, and the Office of Self-Governance will be the lead Federal agency. The Secretary must shape the process to fit Tribal self-governance and the government-to-government relationship. The Secretary may remove any existing regulation that conflicts with this chapter. Except as limited by section 101(a) of the PROGRESS for Indian Tribes Act and except for programs in section 5363(c) of this title, this subchapter overrides conflicting laws and regulations. Not having finalized rules does not stop the subchapter from taking effect or being used.
