Title 25 › CHAPTER 46 — INDIAN SELF-DETERMINATION AND EDUCATION ASSISTANCE › SUBCHAPTER V — TRIBAL SELF-GOVERNANCE—INDIAN HEALTH SERVICE › § 5388
The Secretary must send to a tribe the money promised in any compact or funding agreement. If a payment is set to start at the beginning of a fiscal year, the first payment must be made within 10 days after the Office of Management and Budget apportions the funds, unless the agreement says otherwise. Tribes can ask for multiyear funding. The amount given must equal what the tribe would get under self-determination contracts, including direct program costs and contract support costs and any related funds, no matter which part of the Department provided the services. The Secretary cannot refuse, delay, or split up a tribe’s full share, or cut funds to pay for federal administration or displaced federal employees, except in specific listed cases or to increase funds if needed (see section 5324(c)(2)). If a tribe wants federal staff, supplies, or services, the Department must provide them. The Prompt Payment Act applies to these transfers. Tribes keep any interest earned and program income (including Medicare and Medicaid income except as the Indian Health Care Improvement Act says otherwise). Money stays available until spent and can be carried over to later years. If a tribe finds funds are not enough, it must tell the Secretary and may suspend the activity until more money is provided.
