Title 25 › CHAPTER 48 — INDIAN TRUST ASSET REFORM › SUBCHAPTER II — INDIAN TRUST ASSET MANAGEMENT DEMONSTRATION PROJECT › § 5614
Lets a tribe get approval from the Secretary to run some land leases and forest work on its trust lands without needing the Secretary to approve each deal, as long as the tribe’s leaders agree and the tribe adopts rules the Secretary accepts. Key terms: forest land management activity — any activity listed in the National Indian Forest Resources Management Act; interested party — a person, group, or government that could be harmed by a tribe’s leasing choice; surface leasing transaction — a home, business, farm, or wind/solar lease of land held in trust or held by a tribe with federal limits on selling it. The tribe’s rules for surface leases must be approved by the Secretary under section 415(h)(4) or found by the Secretary to meet the requirements of section 415(h)(3). Rules for forest work must match the Secretary’s forest rules and include an environmental review that finds big effects, tells the public, lets people comment, and has the tribe answer important comments before approving work. The tribe may choose to include leases, forest work, or both. The Secretary can give technical help, including contracts or grants under the Indian Self-Determination and Education Assistance Act. If a project is funded by a federal agency, the tribe may use that agency’s environmental review instead. The tribe must send the Secretary copies of lease or forestry papers and, when payments go to the tribe, payment records. The United States is not responsible for losses from tribe-approved deals, but the Secretary may, after notice, enforce or cancel leases. An interested party, after using tribal appeals, can ask the Secretary to review the tribe’s approved rules. If the Secretary finds a violation, the Secretary can fix it, including undoing approval, but must give a written finding, notice, a hearing, and a chance to correct the problem first.
