Title 25 › CHAPTER 50 — NATIVE AMERICAN BUSINESS INCUBATORS PROGRAM › § 5803
Requires the Secretary to create a grant program in the Office of Indian Energy and Economic Development to help start and run business incubators that serve reservation communities and support Native businesses and entrepreneurs. Eligible applicants include Indian tribes, tribal colleges, other colleges, and nonprofit groups that help businesses and agree to serve one or more reservations. Applicants must be able to supply workspace, equipment, and internet access, and most non-tribal applicants must have been operating at least 1 year. Two or more groups can apply together and must show they meet the rules as a team. Applicants must name a director, agree to site checks and yearly reviews, describe the reservation communities served, provide a 3-year plan for participants and services, show past experience, and describe the site and its technology. The Secretary will check sites by visit, video, or written plan and must follow up within 1 year if only a written plan was given. Grants last 3 years and are paid yearly unless the grantee asks for more frequent payments, no more than quarterly. Grantees must usually match at least 25% of each year’s funds with non-Federal money, though the Secretary can waive that in special cases; renewals (up to 3 more years) require a 33% match. Funds may be used for workspace, partnerships, and usual incubator needs. Grantees must offer culturally tailored services, pick participants by competition, give workspace, teach finance, management, and marketing, provide mentors and investor networks, and use technology for connectivity. The Secretary will do yearly evaluations and grantees must file annual reports. Two years after the first awards, and every 2 years after that, the Secretary must report to Congress on program results, including numbers of businesses, jobs, financing accessed, and incubator performance.
