Summary

The Secretary must decide who the heirs are, if that has not already been done, or update an existing list of heirs for any Native American—whether full-blood, mixed-blood, or enrolled in another federally recognized tribe, band, or community—when needed for this law. The Secretary must accept heirship decisions made by Minnesota state courts as described in section 5(a).

The Secretary shall determine the heirs, if heretofore undetermined, or modify the inventory of an existing heirship determination of any full or mixed blood or Indian enrolled in any other federally recognized Indian tribe, band, or community, where appropriate for the purposes of this Act: Provided, That the Secretary shall accept any determination of heirship by the courts of the State of Minnesota as provided in section 5(a) of this Act.
