Title 26 › Subtitle Subtitle H— Financing of Presidential Election Campaigns › Chapter 96— PRESIDENTIAL PRIMARY MATCHING PAYMENT ACCOUNT › § 9040
The Federal Election Commission can take part in court cases involving the presidential primary matching fund program. It may defend lawsuits using its own attorneys or outside counsel it appoints and pays without following normal civil service hiring and pay rules. It may sue in federal district courts to recover money candidates owe the government after an audit, ask the courts for injunctions to enforce the program, and appeal decisions or ask the Supreme Court to review them on behalf of the United States.
