Defines terms used in the chapter. "Foreign state" means a country's government, its subdivisions, and its agencies or instrumentalities. An "agency or instrumentality" is an entity the foreign government owns or controls (majority‑owned) and that is not a U.S. State citizen or formed under another country's laws. "United States" means all territory and waters under U.S. control. "Commercial activity" means regular business or a business deal, judged by what it is, not why. It is "carried on in the United States" when it has substantial contact with the U.S.
