A judge on the United States Court of Federal Claims may be removed during their term only for incompetence, misconduct, neglect of duty, practicing law, or physical or mental disability. Removal must be ordered by the United States Court of Appeals for the Federal Circuit, and a majority of all that court’s judges must agree. Before any removal order, the judge must receive a full statement of the charges and be given a chance to respond. If the Director of the Administrative Office of the United States Courts learns of a reason to remove a judge, the Director must report it to the chief judge of the United States Court of Appeals for the Federal Circuit and send a copy to the judge.
