Title 28 › Part V— PROCEDURE › Chapter 119— EVIDENCE; WITNESSES › § 1826
A court can order a witness who refuses, without a good reason, to testify or hand over requested papers or recordings to be held in a suitable place until the witness agrees to cooperate. The detention cannot last longer than the court case or the grand jury term, including any extensions. If the witness appeals the confinement, the court can deny bail if the appeal looks frivolous or is meant to delay. The appeal must be decided promptly and no later than 30 days after it is filed. Anyone who escapes, tries to escape, or helps someone escape can get up to 3 years in prison, a fine up to $10,000, or both.
