When someone asks a court to free a person from custody, the court must quickly order the custodian to bring the person or to explain why they are held, unless the request clearly shows no right to relief. The custodian must answer within three days, though the court can allow up to twenty more days for good cause. After the answer, the court must set a hearing within five days unless more time is allowed for good cause. If the case involves facts, the custodian must bring the detained person to the hearing. The detained person may, under oath, deny or add facts. Answers can be changed with the court’s permission. The court must promptly hear the facts and decide the case.
