Title 28 › Part VI— PARTICULAR PROCEEDINGS › Chapter 158— ORDERS OF FEDERAL AGENCIES; REVIEW › § 2350
The Supreme Court can review either an order that grants or denies a temporary injunction under the law or the court of appeals’ final judgment in a review case. A petition asking the Supreme Court to hear the case must be filed within 45 days after the injunction order or within 90 days after the final judgment. The United States, the agency involved, or a party harmed by the decision may file. The same rules for sending questions up to the Supreme Court (certification) and for pausing orders (stays) also apply to these cases.
