Every two years three judges or justices are assigned to a D.C. Circuit panel that picks independent counsels. The D.C. Circuit clerk will serve as the panel’s clerk and give needed support. Panel members can still do other court work unless the conflict rule applies. The Chief Justice names the three, and one must be from the D.C. Circuit. No more than one member may come from the same court. If a spot opens, it is filled only for the rest of that two-year term. If a panel member took part in any action about an independent counsel under chapter 40, that member cannot take part in any court case involving that independent counsel while the counsel is serving, or in any case about the counsel’s official actions even if the counsel is not serving.
